Audience Gasps as Judge Likens Election of Bush to Rise of Il Duce

2nd Circuit's Calabresi Also Compares Bush's Rise to That of Hitler

Josh Gerstein, New York Sun

WASHINGTON — A prominent federal judge has told a conference of liberal lawyers that President Bush's rise to power was similar to the accession of dictators such as Mussolini and Hitler.

"In a way that occurred before but is rare in the United States — somebody came to power as a result of the illegitimate acts of a legitimate institution that had the right to put somebody in power. That is what the Supreme Court did in Bush versus Gore. It put somebody in power," said Guido Calabresi, a judge on the 2nd Circuit Court of Appeals, which sits in Manhattan.

"The reason I emphasize that is because that is exactly what happened when Mussolini was put in by the king of Italy," Judge Calabresi continued, as the allusion drew audible gasps from some in the luncheon crowd Saturday at the annual convention of the American Constitution Society.

Saying No to the Prosecutor

Why Steve Kurtz's Colleagues Refused to Testify to the Grand Jury

Bruce Jackson

A death and a taste of blood

Steve Kurtz's wife Hope died of a heart attack May 11. Steve, an associate professor of art at University at Buffalo, called 911. The police who came saw some of the materials for an art exhibit on genetic modification and called the FBI. The FBI came in, cordoned off half the block, confiscated Hope's s body, Steve's computer, his notebooks, his art supplies and their cat. They took him into custody. Two days later they let him and the cat go and whoever had the wife's body released for burial. There was no supposition of foul play in the death. Kurtz is a member of the highly-regarded Critical Arts Ensemble, a group that does confrontation art works designed to make people think about the role corporations play in modern life.

"Landslide Approval of Irish Citizenship Referendum"
James Davis

Last Friday Ireland went to the Polls to elect local councilors and members of the European Parliament and to decide on an amendment to the constitution which would strip some Irish born children of their right to Irish Citizenship. The referendum is the culmination of the states efforts to limit the rights of asylum seekers and refugees who have arrived on the Island in increasing numbers during the economic boom there over the last 10 years. The referendum was passed by a landslide with 80% of voters approving the new restrictions in a big victory for nativism.

Initially the referendum was proposed by the Minister For Justice, Michael McDowell, as a way of defending Irish maternity hospitals which were, he argued, overwhelmed by foreigners arriving to give birth within the EU. Under the old rules where parents could claim residency rights in the country by virtue of their children’s citizenship, Ireland was out of step with the rest of the EU, or so the argument went until the facts got in the way. While the current right wing coalition government has been plotting some sort of referendum on this matter for years, Friday’s vote was only announced in March. McDowell initially argued that the Masters of the Maternity hospitals had plead for ‘something’ to be done about the hordes of pregnant refugees packing the hospitals. The doctors in question quickly distanced themselves from such claims, realizing perhaps they were being played in a pretty transparent electoral stunt and statistical fraud.

Manifesto for the Unconditional Regularisation of Immigrants

In Spain more than 50% of immigrants have no legal
papers. We are the visible tip of an iceberg of life¹s
precariousness affecting everyone equally .

In order to fight against this situation, we went out
to the streets, we recognised our equals, we built a
platform for struggle, we listened to other people¹s
struggles at the Popular Assembly, we claimed a direct
dialogue with the Administration, we banged our pans
prior to elections, we received from Zapatero promises
which affected us directly, we attended an interview
with the renewed Generalitat de Cataluña... Yet, the
Generalitat still treats us like ³a problem² and takes
back, together with Central Government, the campaign
promises and press announcements. We have knocked on
all doors. Faced with silence and denial of our
fundamental rights, for citizenship is achieved
through the very exercising of itself...

German Fined €8000 for Kazaa Uploads

A 23-year-old man has become the first music sharer to be successfully convicted in Germany for uploading songs to Kazaa. And expect more such cases across Europe, the International Federation of Phonographic Industries (IFPI) warned today.

Anonymous Comrade writes: The FBI is presently investigating Steve Kurtz and other members of the Critical Arts Ensemble, for their possession of a laboratory which can determine whether foods have been genetically modified. This is a classic FBI move to stifle discussion and protect industry profits, by creating gigantic legal bills which the group must pay. From all reports, it is likely there will be a grand jury trial.(www.counterpunch.com)

Kurtz is an internationally recognized lecturer in the areas of genetic manipulation and information technology. Critical Arts Ensemble has published several books encouraging popular response to the specialized field of scientific investigation. (See autonomedia.net).
